Article 94 a. People who are not Polish citizens benefit from the education and care in public kindergartens and those who are under school duty are entitled to education and care in public primary schools, lower secondary schools called gymnasium (gimnazjum), public art schools, including institutions of art, on the conditions concerning Polish citizens.

       1a. People who are not Polish citizens and are under education duty, benefit from education and care at public post-lower secondary schools on the conditions concerning Polish citizens until they are18 years old or leave the public post-lower secondary school.

       2. Under the same conditions as apply to Polish citizens are entitled to education in public post-secondary schools, public art schools, public teacher training institutions and public institutions:

       1) citizens of Member States of the European Union, Member State of The European  
           Free Trade Association (EFTA) - parties to the contract about European Economic
            Area or the Swiss Confederation and their family members having right of residence
           or permanent residence

       2) persons of Polish origin within the meaning of the provisions on repatriation;

     3) persons who were given permission to settle in the territory of Polish Republic;

     4) persons with a valid Pole Card;

       5) persons for whom the entitlement is due to international agreements;

       6) persons granted refugee status and members of their families;

       7) persons with tolerated stay;

       8) persons granted subsidiary protection and their family members;

       9) persons benefiting from temporary protection in the Polish territory;

     10) persons who on Polish territory have been given a residence permit long-term
             resident of the European Communities;

     11) persons who on Polish territory have been given residence permit for a specified
             period in connection with the circumstance referred to in Article 53 section 1 point 7,
           13 and 14 of the Act of 13 June 2003 on foreigners ( Jurnal of Laws of 2006 No 234,
             item 1694 with further amendments);

     12) family members of persons applying for refugee status.

     2a. As family members of persons referred to in section 2:

     1) point 1- are considered persons referred to in Article 2 point 4 of the Act of 14 July
         2006 on entry into the Polish territory, stay and departure from the territory nationals of  
         Member States of the European Union and members of their families (Jurnal of Laws
         No 144, item 1043, of 2007 No 120, item 818 and of 2008 No 216, item 1367);

     2) point 6,8 and 12 - deemed to the spouse and minor children of those unmarried persons
         who are their dependents

     3. People who are not Polish citizens and were not specified in section 2, may benefit from education in public schools, teacher training institutions and in institutions referred to in section 2:

1) as a scholarship holder receiving a scholarship granted by the minister competent for
   education and the upbringing;

2) as a scholarship holder receiving a scholarship granted by the school authority, teacher
   training institution or institution, headmaster, teacher training facility, or institution;

3) under the terms of payment.

      4. People who are not Polish citizens and who are under school duty or are under education duty but do not speak Polish or know it at insufficient level to use the education, are entitled to additional, free of charge Polish language education. The school authority organize the additional Polish language education for those persons.

      4a. The persons referred to in section 4, are entitled to assistance given by the person having a good command of language of the country of origin, employed by the headmaster as a help for a teacher. This help is provided for no more than 12 months.

      4b. The entitlement referred to in section 4 applies also to persons who are Polish citizens and are under school duty or are under education duty but do not speak Polish or know it at insufficient level to use the education; these persons use the entitlement referred to in section 4 but no longer than 12 months.

      4c. The persons referred to in section 4 and 4b may benefit from additional compensatory classes in subjects organized by the school authority but no longer than 12 months.

      5. For people who are not Polish citizens and are under school duty, diplomatic post or consular post of their country of origin operating in Poland, or cultural - educational association of a given nationality can organize at school language education and culture of the country of origin, in consultation with the headmaster and with the consent of the authority conducting. The school provides free room and teaching aids.

      6. The minister competent for education and the upbringing in consultation with the minister competent for culture and protection of national heritage, shall determine, by regulation:

1) conditions and procedures for admission of people who are not Polish citizens to public kindergartens, schools, including art schools, teacher training institutions and institutions, considering in particular types of documents confirming the level of education and health condition, as well as the way of classifying to the appropriate class or on the appropriate semester;

2) amount of the payment for the learning at public post-secondary schools, post-lower secondary schools for adults, art schools, teacher training institutions and institutions as well as way of paying fees, taking into account the expected training costs and the possibility of total or partial exemption from the payment;

3) the way of the organization of additional Polish language education, additional compensatory classes in subjects and language education and culture of the country of origin, referred to in section 4 and 4b-5, including the number of hours of classes and minimum number of people for whom it is arranged the language education and culture of the country of origin;

4) amount of scholarship for persons referred to in section 3, point 1, and cases in which

scholarship may be reduced or suspended, guided by the amount of material assistance benefits granted to pupils under the conditions and procedures set forth under Article 91 section 2.
